THE MEDIATION BILL, 2021
An Act to promote, encourage and facilitate mediation especially institutional mediation for resolution of disputes commercial and otherwise, enforce domestic and international mediation settlement agreements, provide for a body for registration of mediators, to encourage community mediation and to make online mediation as an acceptable and cost effective process and for matters connected therewith or incidental thereto
Definitions
3 (e) "Mediator" means an individual who is appointed to be a mediator to undertake mediation and includes a person registered as mediator with the Council.
Mediation Service Providers
- The mediation service provider recognised by the Council as per the provisions of this Act shall be graded by the Council in accordance with the Regulations made by it in this behalf.
Mediation Institutes (Training)
- The Council shall recognise Mediation Institutes in accordance with the regulations made by it in this behalf.
Community Mediation
- (1) Any dispute likely to affect peace, harmony and tranquility amongst the residents or families of any area or locality may be settled through community mediation.
Mediation Fund
- (1) There shall be a fund to be called 'Mediation Fund' (hereinafter referred to as 'Fund') for the purposes of promotion, facilitation and encouragement of mediation under this Act. The fund shall be administered by the Council.
―Council‖ means the Mediation Council of India established under section 35 of this Act.
